Information Collection and Use

This Privacy Statement applies to the processing of Personal Data collected by us when you:

When you interact with Quark, we may collect personal information relevant to the situation, such as your name, postal address, telephone number, email address business address, shipping address and other contact preferences; information about the Quark products you own, such as their serial numbers and date of purchase; and information relating to a support or service issue.

We also collect information for market research purposes, such as your occupation and where you use your computer, to gain a better understanding of our customers and thus provide more valuable service or market our products and services.

We collect information regarding customer activities on our websites. This helps us determine how best to provide useful information to customers and to understand which parts of our websites, products and Internet services are of most interest to them and to market our products and services.

We partner with Microsoft Clarity to capture how you use and interact with our website through behavioral metrics, heatmaps, and session replay to improve and market our products/services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. If you purchase products or services through Quark, then we may collect payment information from you. We will protect all of your financial information and we will never distribute or publicize your financial information except to the extent necessary to fulfill your order.

For customers that purchase online with a credit card, we only use your payment information in order to fulfil, track, and manage your subscription. We use a third-party payment processor to process payments made to us. When you purchase a subscription through one of our payment processors, we do not retain any financial information such as credit card numbers, we receive only partial information about your card on our servers. Rather, all such information is provided directly by you, to one of our third-party processors, Braintree or PayPal, whose use of your personal information is governed by their privacy policy, which may be viewed via the link in our Service Providers We Use section.

Publicly Displayed Information Is Public

If you use a Quark forum, bulletin board or chat room on a Quark website, you should be aware that any information you share is visible to other users. Personally identifiable information you submit to one of these forums can be read, collected or used by other individuals to send you unsolicited messages. Quark is not responsible for the personally identifiable information you choose to submit in these forums. For example, if you choose to make information, which was previously non-public, available by enabling certain user features, Quark will collect that information from your interaction and the information will become publicly available.

When We Disclose Your Information

Quark takes your privacy very seriously. Personal information that you provide will not be sold or rented to any other party and is only used by Quark and its suppliers to provide you with relevant information about our solutions and services.

To help us provide superior service, your personal information may be shared with legal entities within the Quark group globally who will take steps to safeguard it in accordance with Quark’s Privacy Policy.

With Our Service Providers, Vendors and Strategic Partners
There are also times when it may be advantageous for Quark to make certain personal information about you available to companies that Quark has a strategic relationship with or that perform work for Quark to provide products and services to you on our behalf. These companies may help us process information, extend credit, fulfill customer orders, deliver products to you, manage and enhance customer data, provide customer service, assess your interest in our products and services, market our products and services, or conduct customer research or satisfaction surveys. We cooperate with law enforcement agencies in identifying those who use the Service for illegal activities. Therefore, we respond to subpoenas, warrants or other court orders regarding information concerning any users. We will, at our discretion, disclose information if we believe that we are required to do so by law, that such disclosure is necessary to protect us from legal liability or that we should do so to protect the integrity of the Service.

Quark uses administrative, technical and physical measures to safeguard your personal information against loss, theft and misuse, as well as unauthorized access, disclosure, alteration and destruction.

We do not knowingly collect personal information from minors (individuals below the age of 18) and no portion of the Service is directed towards minors. We do not knowingly solicit any information about minors or market to minors. If a minor submits personal information to Quark and we learn that the personal information is the information of a minor, we will attempt to delete the information as soon as possible. At the time the minor’s information is submitted, it is treated the same as all personal information under the Quark Privacy Policy.

Additional Disclosures for California Residents

Quark discloses the following categories of personal information for commercial purposes: identifiers, demographic information, commercial information, internet activity, geolocation data and inferences. We use and partner with different types of entities to assist with our daily operations and manage our Services.

b. Right to Know and Delete

If you are a California resident, you have the rights to delete the personal information we have collected from you and know certain information about our data practices in the preceding 12 months. In particular, you have the right to request the following from us:

c. Right to Opt-Out

To the extent Quark sells your personal information as the term “sell” is defined under the CCPA, you have the right to opt-out of the sale of your personal information by us to third parties at any time. You may submit a request to opt-out through our webform located at https://www.quark.com/privacy. You may also submit a request to opt-out by calling our toll-free number at 1-800-676-4575.

d. Authorized Agent

You can designate an authorized agent to submit requests on your behalf. However, we will require written proof of the agent’s permission to do so and verify your identity directly.

e. Right to Non-Discrimination

You have the right not to receive discriminatory treatment by us for the exercise of any your rights.

f. Minors

We do not knowingly “sell” the personal information of minors under 16 years old who are California residents without their affirmative authorization.

g. Shine the Light

Customers who are residents of California have the right to request a disclosure describing the categories of personal information we have shared with third parties for their direct marketing purposes, and with whom we have shared it, during the preceding calendar year. You may request a copy of that disclosure by contacting us as set out in the “Contact Us” section above and specifying that you are making a “California Shine the Light Request.” We may require additional information from you to allow us to verify your identity and are only required to respond to requests once during any calendar year.

Additional Disclosures for Nevada Residents

Nevada law (NRS 603A.340) requires each business to establish a designated request address where Nevada consumers may submit requests directing the business not to sell certain kinds of personal information that the business has collected or will collect about the consumer. A sale under Nevada law is the exchange of personal information for monetary consideration by the business to a third party for the third party to license or sell the personal information to other third parties. Quark acts as a controller with respect to personal data collected as you interact with our websites, emails, and advertisements.
